By placing any order with us you are agreeing to these
Terms and Conditions.


Wedding, Events and Deliveries Terms and
Conditions


1.1 Order Processing and Payment

1.2 The Garden Room Flower Company will not hold your contact
details in any database. Your data will never be sold or released to a
third party to use for their own purposes. The Garden Room Flower
Company will retain your data and will use it only to communicate with
you on The Garden Room Flower Company- related issues and to
provide information that may be of use to you for the future. No
payment details will be held on the seller’s premises.

1.3 For an order to be processed and delivered on the required date,
the Buyer must supply the Seller with all the relevant details
requested, including full delivery details, post code and telephone
number. The order will only be processed if full payment details are
given.

1.4 The Buyer is entirely responsible for any text or other material
which he requests when placing his order and the seller accepts no
liability for any such content. However, the Seller reserves the right to
refuse to send or display messages and terminate access to the
relevant Services at any time and without liability in the event of
detecting objectionable wording or message

2 Delivery Terms and Delivery Related Problems

2.1 We are not liable for any deliveries unable to be fulfilled due to
forces beyond our reasonable control, such as severe weather,
mechanical breakdowns, road traffic accidents.

2.2 If we experience difficulties in sourcing the agreed flowers/plants
we will contact you immediately. In such circumstances, we reserve
the right to substitute goods of a similar price and quality; however, this
will be agreed with you in advance whenever possible.
All of your personal information will be kept strictly confidential and not
shared with any third parties.
We will use commercially reasonable efforts to adhere to all agreed
timelines and have no liability for failure to meet the agreed timelines,
unless such failure is solely and directly due to our actions.

2.3 In case the recipient is not at home at the time of delivery, the
driver will attempt to leave the order with a neighbour (unless the
Buyer specifically requests that this should not be done) and leave a
card at the recipient’s address. The card will be the Seller’s proof of
delivery. It should be noted that it is then the recipient’s responsibility
to collect the order from the neighbour.

2.4 If the driver is unable to deliver the flowers using one of the
options above, the Seller will attempt to contact the Buyer via email or
telephone to resolve the delivery issue. If no contact can be made at
the time of attempted delivery, the order will be returned to the
workshop and the Seller will await contact from the Buyer.
Should the Buyer decide to cancel the order instead of arranging a
redelivery, the Seller reserves the right to deduct a cancellation fee
from the refund value.
In some instances, for example, when delivering to some business
addresses, hospitals or universities, it may not be possible to deliver
the flowers directly to the intended recipient. In this case, the driver will
deliver to the reception area or post room and try and obtain a
signature from the receptionist. This signature will be the Seller’s
record of delivery.

3 Delivery Cancellation and returns

3.1 Under the Distance Selling Regulations, if you buy online or by
phone, your consumer rights entitle you to a full refund if you request
one in writing within seven (7) Working Days of receipt. This obviously
makes no sense for fresh flowers, so by placing your order, you agree
to wave your rights to cancel orders.

3.2. Although the seller will do his best to ensure that this does not
happen, on very rare occasions, flowers arrive at their destination
damaged. If the recipient receives damaged flowers, the Buyer should
contact the Seller immediately by indicating the order details provided
at the time of ordering (at the latest within 24 hours after delivery) so
that either a resend or a full refund can be arranged.

3.2 Any complaints must be made within 24 hours along with
photographic evidence. No responsibility can be taken with regards to
poor condition once flowers have been approved
These Terms and Conditions shall be governed by and construed in
accordance with the law of England and the parties hereby submit to
the exclusive jurisdiction of the English courts.

4 Wedding and Event Consultation

4.1 Consultations are complimentary and each event is entitled to a
one hour initial consultation and one hour final consultation by
appointment only. Email and telephone contact is welcomed during the
planning process. However, additional consultations and site meetings
may incur charges;

4.2 Extra one hour consultation £25.00

4.3 On site visit fee to be agreed with travel time


5 Wedding Payment and Deposits

5.1 A £200 booking fee is payable at the time of ordering, this confirms
your booking with us. This is non refundable and the remaining
balance is due two weeks before the wedding date.
( Deposit may vary depending on the size of the wedding )

5.2 Your wedding date is reserved for 14 days from the date of the
quotation.


5.3Terms and Conditions may be updated at anytime. By paying your
booking fee you are agreeing to any changes that may be made.
These will always only be minor changes to wording. Any major
changes that could effect you will be presented to you first.
Minimum wedding budget £900
 

6 Photography

6.1 You agree that we may display photographs of our products taken
at your wedding or event on our website or in our literature. If any
individual is included in such photographs we will obtain your consent
before using them.


7 Wedding /Events changes

7.1 We can only accept changes made to orders 14 days before a
wedding or event. All changes must be made before the final payment
is made which is due 14 days before your wedding date.
If you cancel your order less than 14 days before the date of the
wedding or event then we cannot refund payments made.

7.2 We can accept no further liability for products once delivered to the
agreed location.

7.3 Where we need to gain access to a premises you agree to arrange
this access for us. If we are unable to gain access at the agreed time
we are not able to guarantee that we can adhere to all agreed
timelines. We cannot accept liability for cost or damage due to us not
being able to gain access at the agreed time.

7.4 We will use commercially reasonable efforts to adhere to all
agreed timelines and have no liability for failure to meet the agreed
timelines, unless such failure is solely and directly due to our actions.

7.5 If we experience difficulties in sourcing the agreed flowers/plants
we will contact you immediately. In such circumstances, we reserve
the right to substitute goods of a similar price and quality; however, this
will be agreed with you in advance whenever possible.


8 Hire and use of vases/containers

8.1 A refundable deposit of £is charged for this service. Containers
must be returned to ‘the garden room flower co’ within 3 days, – or as
agreed.

8.2 Charges will be made for any glassware returned cracked, chipped
or broken. Replacement of goods is charged at the current purchase
price, it is then the responsibility of the hirer to reclaim any of these
costs from the venue if the venue was at fault.

8.3 Equipment hired (jugs, bottles, vases, plinths, candelabras, etc.)
remain the property of ‘the garden room flower co at all times.
‘the garden room flower co accepts no liability for injury, loss or
damage to the hirer or any third party of any equipment hired for use at
the event


9 Wedding and Event Deliveries and installations

9.1 Deliveries will need to be signed for and care details will be
provided. We do not take any responsibility for the care or freshness
due to the environmental conditions after delivery. Please check,
queries must be raised within 30 minutes of delivery by telephoning
07876256215. Nominated person to check the order prior to me
leaving the site.
 

10 Cancellations and Limitations

Our liability for losses you suffer as a result of us breaching this
agreement is limited to the purchase price of the product you
purchased. We are not responsible for indirect losses which may occur
as a consequence of the main loss or damage, including, but not
limited to;

1. Reduction of enjoyment of special occasions, such as weddings
or special parties
2. Reduction in colour co-ordination or quality in pictures taken of
events
We will not be liable or responsible for any failure to perform or delay
in performance of any of our obligations that is caused by events
outside our reasonable control.
Events outside our reasonable control include any act, event, non-
happening, omission or accident beyond our reasonable control and
includes in particular (without limitation) the following:

1. Strikes, lock-outs or other industrial action.
2. Civil commotion, riot, invasion, terrorist attack or threat of
terrorist attack, war (whether declared or not) or threat or
preparation for war.
3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic
or other natural disaster.
4. Impossibility of the use of railways, shipping, aircraft, motor
transport or other means of public or private transport.
5. Impossibility of the use of public or private telecommunications
networks.
6. The acts, decrees, legislation, regulations or restrictions of any
government.
7. Unusual weather conditions
8. Pandemics, nationwide lockdowns

Our performance under any Contract is deemed to be suspended for
the period that the event which is outside of our control continues, and
we will have an extension of time for performance for the duration of
that period.
In the very rare event of The garden room flower Co. not being able to
execute your order due to ill health or events out of our control a
freelancer, or trusted outside company would be brought in to manage
the contract. If this was not possible a full refund would be provided.

11 Workshops and Classes

Our cancellation policey: If for any reason you are unable to attend the class and you notify us 48 hours in advance of the class, then we will refund you in full. After this time we can only offer you 50% of your total payment.

Extra points to note

“ the garden room flower company does not accept responsibility for
any injuries or damages sustained as a result of broken glass,
materials, dyes, reactions to materials. Liability is limited to the supply
of goods only.

These Terms and Conditions shall be governed by and construed in
accordance with the law of England and the parties hereby submit to
the exclusive jurisdiction of the English courts


Privacy Policy and GDPR

This Privacy Policy information has been prepared in accordance with
Data Protection Act 1998 and the general Data Protection Regulation
GDPR 2018.

Who are we

Any information you share with The Garden Room Flower Company is
controlled by us The Garden room flower company.
What information we collect and hold about you.
When you place an order we collect information about you. This
generally includes Name, Address, email address, Telephone number
and payment details.

How we use your information
The information you share with us on placing an order allows us to
process and fulfil your order and to assist you with future customer
enquires.

Sharing your information
The information you share with us is Private and we do not share to
any third parties. We do not share your data with other companies.
